Cabinet adopts new infection protection measures ordinance

The SARS-CoV-2 Infection Measures Ordinance comes into force tomorrow (Friday, 18 March) and applies up to and including 2 April 2022.
Brandenburg extends important coronavirus protection measures up to and including 2 April. The cabinet adopted a new corona ordinance for this purpose today in a special digital meeting. The SARS-CoV-2 Infection Protection Measures Ordinance comes into force tomorrow, Friday (18 March), replacing the previous Containment Ordinance. In view of a nationwide seven-day incidence of 1,582 today and a corona traffic light that has been red for over two weeks in the nationwide seven-day hospitalisation incidence, Brandenburg is therefore taking advantage of the transitional regulation planned by the federal government in the new Infection Protection Act, which is to be passed tomorrow by the Bundestag and Bundesrat.

Overview of the most important corona rules from 18 March
There are no longer any contact restrictions for private gatherings in private and public spaces, not even for unvaccinated persons.
The obligation to provide proof no longer applies (i.e. no more 3G) for services close to the body, accommodation facilities, coach trips, city tours and boat trips as well as for events without entertainment character.

3G (instead of 2G) applies to sexual services and major events. In addition, there are no longer any maximum number of people or capacity restrictions for large events. 2G (instead of 2G-Plus) applies to discos, clubs and festivals. Visitors to health and social care facilities are no longer required to provide contact details.

Rules with details
At least one medical mask (surgical mask) must be worn by guests, visitors or participants in enclosed spaces: religious events, non-religious weddings and funerals, events without entertainment character, services close to the body, restaurants, accommodation facilities, local public transport for school transport and for children under 14 years of age, sports facilities outside of sports activities, indoor playgrounds, training and further education facilities.

FFP2 masks must be worn by guests, visitors, customers and passengers in enclosed spaces: Retail, entertainment events, major events, coach tours, city tours, boat trips, local public transport including taxis, memorials, museums, exhibition halls, galleries, planetariums, archives, amusement parks, zoos, wildlife reserves, zoological and botanical gardens, theatres, concert halls and opera houses, cinemas, trade fairs, exhibitions, amusement arcades, casinos and betting shops, health and social care facilities such as hospitals and care facilities.

The 3G rule (fully vaccinated, demonstrably recovered or tested negative) applies to: Events with an entertainment character, major events, restaurants, sports in sports facilities (indoors), indoor playgrounds, theatres, concert halls and opera houses, cinemas, trade fairs, exhibitions, amusement arcades, casinos and betting shops, fun and leisure pools, outdoor swimming pools, saunas, spas and wellness centres, amateur artistic ensembles (rehearsals and performances), health and social care facilities such as hospitals and care facilities, training and further education facilities, sexual services.

The 2G rule (fully vaccinated or demonstrably recovered) applies to: Discos, clubs, festivals and similar establishments.

Schools: Pupils must continue to be tested at least three days a week (self-test at home). Teachers and other school staff must be tested daily. This testing obligation does not apply to fully vaccinated persons and persons who have demonstrably recovered. In indoor areas, pupils and all teachers and other school staff must wear at least one medical mask (surgical mask).

Daycare centres: As before, children in care must be tested at least two days a week (self-test at home); children up to the age of one are exempt.

Distance requirement: Every person should maintain a minimum distance of 1.5 metres from other people outside of private space (exceptions as before, e.g. for spouses or partners and between children).

Amendment to the Infection Protection Act
The previous legal basis for most coronavirus protection measures in Germany will expire at the end of 19 March 2022. The regulations in Section 28a (7) to (9) and Section 28b of the Infection Protection Act (IfSG) are particularly affected. The Bundestag and Bundesrat will vote on the draft bill to amend the Infection Protection Act this Friday (18 March).
The draft provides for a two-week transition period to avoid gaps in regulation and protection. This means that existing regulations in the federal states, such as further mask requirements or access restrictions, can remain in place until 2 April - with the exception of contact restrictions or upper limits on the number of people allowed at events.
